Terms of Use

These terms apply when you use Nitido. By using the app you accept them. Please read sections 3 and 6 in particular: they explain what a colour analysis from a selfie can and cannot do, and how the subscription works.

1. Who you are dealing with

Nitido is provided by Kevin Baur, an individual developer based in Austria, reachable at nitido@kevin-baur.com.

2. What Nitido does

Nitido estimates your colour type from selfies taken with your phone’s front camera. It is based on armocromia, the seasonal colour analysis: the app reads your undertone, depth, contrast and clarity, places you in one of four seasons and twelve subtypes, and shows you a palette of thirty colours plus six to avoid. On that basis it rates garments by colour, keeps your wardrobe and suggests outfits.

3. How reliable the result is

The method itself has limits. Armocromia is a method of aesthetic advice, not a scientific or medical standard. There is no single agreed way to assign a season, and even trained consultants who drape fabrics next to your face in person do not always agree, especially on the subtype. Nitido does not replace a consultation with a colour or image consultant.

A photo is not your skin. Nitido measures colours from photos, and many factors change what the camera sees. Many of them depend on you and your surroundings:

• Light: daylight or lamp light, its colour temperature, direction and strength, the time of day, shadows, and coloured light reflected from walls, furniture or clothing close to your face
• Camera and phone: quality of sensor and lens, automatic white balance and exposure, HDR, portrait mode, filters or beauty effects, a dirty lens
• You: make-up, self-tanner, a tan, redness, hair colour reflecting onto your skin, glasses, eyes that are closed or half closed, hair or a hat in your face
• How the photo is taken: distance, angle, a face that is not fully in the frame, movement or changing light between the shots
• Your screen: every display shows colours slightly differently, so a colour in the app may not look exactly like a fabric, a lipstick or a hair colour in real life

The app checks every measurement and rejects some bad shots, for example too much light, too little light or clearly yellow light. It cannot detect every problem: a slightly warm light, for example, can shift the result without any visible warning.

Borderline results are normal. Most people are not a pure type and sit between two neighbouring types; the app shows you both. If you are close to a border, measuring again under different conditions can give you the neighbouring type, and occasionally a different season. That is a limit of the method, not a malfunction. The measurement is also improved over time, so a new version of the app can place you slightly differently than an older one.

The same applies to garments. Scores for clothing depend on the light in the shop or at home, on the photo, and on how well the garment could be separated from its background.

So: follow the instructions in the app (daylight from a window in front of you, no make-up, hair covered, no filters), repeat the measurement if you are unsure, and use your own judgement before buying clothes, make-up, hair colour or anything else based on a result. Those decisions remain yours. Nitido is not a medical or dermatological tool and says nothing about the health of your skin.

4. Your account

An anonymous account is created when you first open the app; you do not need to register. You can link Sign in with Apple so your data survives a change of phone. You can delete your account and all data stored with it at any time in the app under “Elimina account e dati”. Deleting your account does not cancel a subscription, see section 6.

Nitido is intended for people aged 16 and over.

5. Using Nitido properly

• Only measure your own face, or the face of someone who has agreed to it
• Checking an image from your gallery or the internet gives you no rights to that image
• Do not copy, decompile or resell the app, its palettes or its content
• Do not work around the subscription or other technical limits, and do not interfere with the service
• Do not use Nitido in a way that breaks the law or infringes other people’s rights

6. Subscription

Your own measurement, your personal palette, the garment scanner, the wardrobe and outfits require an active subscription. Before you buy, the app shows an example result on a demo face, not a measurement of yours. There are two plans, which unlock exactly the same features:

• Weekly: billed once a week, renews automatically every week
• Yearly: billed once a year, renews automatically every year

The current price of each plan is shown in the app before you buy, in your local currency and including applicable taxes. For the yearly plan the app also shows the equivalent price per week for comparison; you still pay the full yearly price at once. Nitido offers no free trial, no introductory period and no free access to paid features.

Payment and renewal

Subscriptions are sold and billed by Apple through your Apple Account; payment is charged to it when you confirm the purchase. The subscription renews automatically for the same period at the then current price unless auto-renew is turned off at least 24 hours before the end of the current period. Your account is charged for the renewal within the 24 hours before the current period ends.

Cancelling

You can cancel at any time in your Apple Account settings (on iPhone: Settings, your name, Subscriptions) or in the app under “Gestisci abbonamento”, which opens Apple’s subscription page. Cancelling stops the next renewal; you keep access until the end of the period you have already paid for. Deleting the app or your Nitido account does not cancel the subscription.

“No commitment” in the app means exactly that: you can cancel whenever you want, and there is no minimum term beyond the period already paid. A period that has started is not refunded pro rata by me.

Switching plans

Weekly subscribers can switch to the yearly plan in the app. The switch is processed by Apple, which decides when the new plan starts and how remaining time on the old plan is taken into account.

Price changes

If the price of a plan changes, Apple informs you in advance. Where Apple’s rules require it, an increase applies only once you have agreed to it; if you do not agree, the subscription ends at the end of the current period.

Refunds and right of withdrawal

Because Apple sells the subscription, refunds are handled by Apple under its terms, not by me. You can request one at reportaproblem.apple.com. If you live in the EU, Apple’s terms give you the right to cancel a purchase within 14 days of receiving the receipt without giving a reason; for subscriptions this applies to the initial purchase, not to each renewal. Your statutory consumer rights remain unaffected.

Restoring

After reinstalling the app or changing phones, tap “Ripristina acquisti” in the app to restore an active subscription bought with the same Apple Account.

7. Your photos

Photos you take in Nitido are processed on your phone and are not uploaded; the details are in the Privacy Policy. You keep all rights to your photos.

8. Availability

Nitido is provided as it is. I do my best to keep the app working and the analysis accurate, but I cannot promise that it is always available, free of errors or works on every device. Features may change. If a change significantly reduces what an active subscription includes, you can cancel; your statutory rights remain unaffected.

9. Liability

To the extent the law allows, I am not liable for indirect or consequential damage arising from the use of Nitido, in particular not for clothing, make-up, hair colour or other products bought on the basis of a result (see section 3). This does not limit liability for intent or gross negligence, for injury to life, body or health, or under mandatory law such as product liability. Your rights as a consumer, including the legal guarantee of conformity for digital content and services, remain unaffected.

10. Apple

These terms are agreed between you and me, not with Apple. Apple is not responsible for Nitido or its content, has no obligation to provide maintenance or support for it, and is not responsible for addressing claims relating to the app, such as product liability claims, claims that it fails to meet legal or regulatory requirements, or intellectual property claims. If the app does not conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price; to the extent permitted by law, Apple has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. You confirm that you are not located in a country subject to a U.S. Government embargo and are not listed on any U.S. Government list of prohibited or restricted parties.

11. Ending it

You can stop using Nitido at any time and delete your account in the app; remember to cancel your subscription separately. I may suspend or remove an account that seriously breaks these terms.

12. Changes

These terms may change; the date at the top of this page shows the current version. Significant changes that affect subscribers will be pointed out in the app in advance. If you keep using the app after a change, the new version applies.

13. Applicable law

Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, you keep the protection of the mandatory rules of the country where you live, and you can bring proceedings in the courts there.
